So i had the dumbest run in ever with a cop the other night. i was driving home to MA after finishing recording of our cd in rochester NH. and i'm going down 125, and for those of you who are familiar with the road, i was in barrington/strafford, had just passed the spinelli cinemas, and was doing 60 in the 50. a cop coming from the opposite direction turns on his lights, does a 180 and pulls me over. i figure eh fuck it, a lil bit of speeding no biggie, prob just get a warning for it, since this was the first time i've ever been pulled over. after taking my liscense and registration, he has me get out of the car, searches me three fucking times because he didn't believe i wasn't carrying a weapon or any narcotics on me. takes my pack of cigarettes and throws it on his hood, throws my lighter in the woods, and tells me that it's illegal for me to have cigarettes in NH and that this was a major violation . he then takes my bassist out of the passenger side of the car, searches him, then tells me to open my trunk, and that if i dont it would mean grounds for arrest. so i open my trunk, he searches through it, gets pissed he can't find any drugs, and then proceeds to search the car. while searching the car, he finds my air soft 6mm that i had, and freaks out cause he thought it was a 9 and that it was real. (i spray painted it black to fuck with people) i explained to him how to take out the clip so he saw it was just lil plastic pellets, and he puts that back in my car. after tossing everything i had in my glove compartment all over my floor, and making a total fucking mess out of my car, he harrases me about the cigarettes again, because he took the other 5 packs i had in my carton out of my car. asks why i had so many, explained where i live in ma, i buy them by the carton up in NH cause there so much cheaper. then he tells me to open my trunk again. he proceeds to ask me what i think could be the dumbest question i've ever heard in my entire life. "Why do you have two buckets of sand in your trunk" i just kinda stared at him and was like well this car handles horribly in the snow, i need it for extra weight for traction. (my car is an 85 chevy caprice classic) so after a full hour of him searching through everything he possibly could, because he was convinced i had drugs and alcohol in the car, he tells me to sit in the car. comes back, tells me the good news is i'm not getting a speeding ticket, and also claims i was doing 51 in a 35? but im getting a summons to court over illegal possesion of tobacco. so now i've gotta go to court over this, because some dick was pissed he couldn't find anything on me. he even said to me "well i couldn't FIND anything worth while, so these will do" total bullshit.

haha, the cops there have nothing better todo than that.
you've got all the luck to meet the one cop in barrington after 9pm.
once Celabs Country Store closes there isn't even the need for the cops to be there. if you had made it 2 or 3 miles down the road, you would have been in lee and they don't even have cops there at night (durham's come out some times).

right where you are talking about, the road goes from 35 to 50. that is a notorious place for cops to watch for people to start speeding up too soon. heck, I think I was pulled over there once before coming back from the "big city" of rochester. the cop tried the same bs about searching my car. I told him that he didn't have the right to search the car. he made me empty out my pockets and patted me down for "his own protection". he sat there with his hand on his gun the whole time.
then he searched the car from outside with a flashlight and asked me questions about what was in bags. I was polite and each time he asked to search my car, I said that it was my right for him not to search my car and he didn't.

PS: in NH it's a big deal to stop kids from smoking. I guess they were ticketing kids like crazy. I for one am all for it. smoking sucks and is one of the gayest things in the world. I hate going to shows in NH cause of the smoke and a lot of times I just wont go to a show cause my lungs kill and my cloths/camera equipment stinks. If I die from lung cancer cause my love of music when I never smoked, I'll be in hell waiting for you fuckers.

toggletoggle post by dreadedsilence at Dec 20,2005 1:04pm

toggletoggle post by largefreakatzero at Dec 20,2005 1:08pm
Yeah, that sounds all pretty much like an illegal search, but I'm sure the cop figured that you probably don't have the money / interest to hire a lawyer / file a complaint. He probably just injected some steroids and was feeling pretty special.
What's the deal with the cigarettes? How old are you?

toggletoggle post by Arthur_ATD nli at Dec 20,2005 1:16pm
i'm only 17, which is why it's illegal. rev, i'm pretty sure it musta been the same cop, first thing safety came off the gun, hand didn't come off the gun, cept to pat me down, and then the flashlight was being held like he was gonna hit me with it, i was kinda waiting for that actually..... i bet it was a kinda tall skinny guy with black hair, a crue cut and an earing. scrawny punk. he told me it was grounds for arrest, and i didn't feel like dealing with him, so i thought it'd be over if i just let him search the trunk. funny thing is, he pulled over my father when he was riding in the same area over the summer on his bike looking to harass him too. godamn barrington cops having nothing to do.

toggletoggle post by the_reverend   at Dec 20,2005 1:20pm
barrington cops?
more like barrington cop.

my friend works at celabs and lives in the house right behind it. he got pulled over right there at the lights and basically everyone in the town drove by, staring. his dad drove home and then walked over to talk with the cop.

on a side note...that's not the dumbest cop story ever...pehaps the cop was dumb...but this is the dumbest thing i've ever heard involving cops

these kids i know were driving around backroads, unknowingly being followed by a cop(on his way home, which factors into the story), and they were rolling a blunt. when they were done the kid compiled the trash and through the blunt wrapper out the window, and it landed DIRECTLY on the windshield of the cruiser. the cop pulls em over, gives it back, and said "stop littering"

that's about the jist of it, the details might be a bit off, but that's pretty much what happened

Understood and accepted. I have no cure for that Tom, and that's not the worst of my worries. Seperation of Church and State is a Constitutional Law. What worries me the most is the fact that Michael "IDIOT" Newdow is now attacking the "In God We Trust" on our money. And if we allow lawyers (as Newdow is a lawyer) to manipulate our courts into changing something as permanent as that phrase on our money, where will they stop? It will set a precident that lawyers can argue anything in this lawsuit happy country. There will be no stopping lawyers with arguments at any level. Newdow will open up a door of mediocrity in this country that will never be shut for as long as we and our children shall live.

That....is what worries me the most about baseless arguments, and makes me cringe as I look to the future.

well changing something like that would be as easy as not printing "in god we trust" on any new currency, It wouldn't be that difficult to do. It is kind of bullshit that it says that on friggen money.

If we allow these far left wingers and their lawyers to have their way with everything that we as a whole or part grasp as Americans, they'll never stop. What would you say to a ban on Metal? You would hate it, right? What about a law that states that you can no longer own guns and protect your family? Then the only ones WITH guns are the criminals that can get them and are willing to use them. Lawyers want to sue the gun industry...compliments of Viacom's Sumner Redstone and his liberal cronies. What about the Dem's wanting to sue the tobacco industry because cigarettes cause cancer? NO SHIT...then stop suing and quit fucking smoking!! What if they go after delicious HAM because it's high in sodium and causes hypertension? Should they sue the hog farmers? NO, they should tell the fat fuck with high blood pressure to stop eating ham...

My point is that nobody in this country is held accountable for their actions anymore. With a good lawyer, you can get away with murder. The media and lawyers are poisoning this country to the point of no return. Hell, half of the kids on this site got their opinions from their friends who invariably got THEIR opinions from MTV or some other media outlet.

My position: Hold people accountable for their actions and stop the whining. The Dem's are still name calling and whining like sore losers, and in turn, they set a bad example for their supporters, and their cause by looking like a bunch of unorganized, grabastic, whiny children who want Mommy to wipe their tears and get a win once in a while just to help improve their self-esteem.

toggletoggle post by Hoser at Dec 20,2005 4:19pm
Tom, that wasn't the point. The point is that the lawyers won't stop. Eventually, lawyers will run the fucking country, manipulating any court that they want to because they know that with a hard enough fight, they'll eventually exhaust their opponents of legal funding and win by default.

Next time tell him to arrest you. Never let them search your vehicle. If you are being pulled over, try and pull into a shopping plaza parking lot. They can't get you for anything unless they were summoned by the owners of the plaza for a crime committed on that private property. Finally, do not waste money on a lawyer unless you are up on murder charges. You can talk to the prosecutor yourself and get a better deal than any lawyer could get you.

I fall under none of those. I started smoking because it was something I wasn't supposed to do, coupled with curiosity. Same reason I played with fire as a kid, started masturbating, drugs, staying out past curfew, etc.... It was pretty standard fare teenage rebellion, and now I've got a nice addiction to a carginogenic substance to show for it.

So explain the part where you think smokers aren't already aware of their bad habit, that they need you to help drive the point home.

Bad advice. Let a cop do whatever he wants to do. However, make it a point to clearly state for the record that you are not giving him PERMISSION to search your vehicle. That way, anything he found can later be thrown out as an illegal search and seizure. (Federal law)

If you are being pulled over, try and pull into a shopping plaza parking lot. They can't get you for anything unless they were summoned by the owners of the plaza for a crime committed on that private property.

Bad advice. 1), you're referring MA private property law, not NH. Secondly, the law provides that cops cannot go after someone for somthing they're doing ON private property without a resident complaining. For example, in MA they can't write you a ticket for blasting your radio in a grocery store parking lot unless someone calls and complains. They can harass you about it, but can't ticket you. However, there are some exceptions, like parking in a fire lane, etc... ALSO, they can pull you over on private property and bust you for something you did if it was not on private property. In other words, even in MA, he would still get pulled over in a parking lot, since the original justification was that he was speeding.

Finally, do not waste money on a lawyer unless you are up on murder charges. You can talk to the prosecutor yourself and get a better deal than any lawyer could get you.

Bad advice, AGAIN! A lawyer, even court appointed, can get charges dropped. DA and prosecutors can only commute, continue, or lessen charges. ALWAYS ALWAYS ALWAYS get a lawyer for ANY JAILABLE OFFENSE, or anything that will affect your criminal record if found guilty. Pleading to a continuance for a first time DUI seems like a great idea, til you get pulled over 30 years later with a few beers on your breath and find out it STILL counts as a second offense, and can cost you a few years in jail.

Never let the fucking pigs search your car. They can't do it without a warrant, but they'll do their best to make you think they can. They'll approch your car guessing that you're young and probably don't know your rights, so they'll use it against you. The only thing he could legally nail you for are the cigs, but I feel if you're retarded enough to smoke those in the first place then that's your business, they are more harmful than many "illegal" drugs, and cause more deaths, but as long as I don't have to breathe it, anywhere, ever, go ahead. It's good to know that kids today are still going through the same harrassment and bullshit that I went through at that age...the cops in Hollistion, Hopkinton and Milford like to pull you over and walk around your car thinking up new things to threaten you with tickets for.

In a country with supposed freedom of religion the statement "In God We Trust" only applies to those who actually believe in this "god" fellow, (specifically christians) and think he's important enough to mention on the entire country's currency, and not to those who don't. Therefore it's a direct violation of Seperation of Church and State, along with that bullshit they make you say in school every morning with your hand over you heart, just like the Romans. I don't trust this "god" or the money you trust him with, so it should be removed.

If you let a cop do whatever he wants to, is he going to state that he searched your car without your permission? Also, you were under 18 and he searched you without your permission or your parents permission. Who is the court going to believe you? or the cop?

i just think the fact I'm going to court over cigarettes is retarded, especially since I'm 18. Something I've found out that some people may be interested in knowing. It is ILLEGAL for an officer to change the manner of a routine traffic stop ex:speeding, running a red light or a stop sign, etc etc. if you get pulled over for speeding, but then have your car searched, none of that can hold up if you claim that the officer changed the grounds of the stop. Also, it is illegal if you get held longer than the amount of time required to write a ticket for whatever violation you were pulled over for. This is actually a law in NH known as the Terry Stop. so..... I'd say even if this dosen't get dismissed immediately, I at least have some type of argument. Illegal search and seizure anyway.

it would be hilarious if you got pulled over and the cop was at your window and your phone goes off and your ringtone was "cop killer" by body count... or "fuck tha police" ... oh man, that would own.
