scars don't pay too well. my friend at work sued over scars from a ladder falling off a private contracting truck (the state police refused to give the company in the documents cause the contractor was hired by the state). When the driver swerved into the breakdown lane to avoid the ladder, they were hit from behind by an 18-wheeler. he's got scars on his bicep, ear, neck and the payout was like $3K. not really worth it to have scars for 60 years.

Face it folks. She'll either win the law suit, or the city will settle for a shitload of shutup cash. If I had that kind of payday coming just for being a moron I'd do it too.

alright, I work for an insurance company and we usually cover these general liability claims.

She has the right to follow a lawsuit, even if she wasn't hurt. She could receive millions for this due to the potential liability involved. you DON'T ever leave a manhole unattended, especially in an urban environment with lots of people around. It is 100% the construction company's fault, and they'll get sued. We do tons of NY Contractors here and I won't be surprised if I'll see this pop up on my desk.

Sounds ridiculous, but it's never the person's fault in general liability situations like this. If the company/store had the means to clean it up and employees on the job, THEY are liable for the protection of the customers, no matter what the customer does. Of course, if the customer gets hurt on purpose (happens all the time so people can get money) then they'd have to examine the evidence in court.
people, it's not hard taking advantage of situations for money. I'd suggest that if anyone sees an unattended manhole in MA, fall down it and bust an ankle, then sue for potential loss of life. Simple money

i just don't see it the way everyone else does. i mean if something fell off of a roof and landed on her head, that is one thing. but when people slip at a grocery store, fall down a manhole, or something that is a result of them just not paying attention, i have no sympathy. especially in this case where she was fucking texting. "i got hurt because i'm stupid, but i'm going to sue you because you should have been paying attention to the fact that i'm stupid". it just doesn't make sense to me.

everything has a liability attached to it. insurance companies are very evil corporations, and take your money based off of the probably of some texting idiot slipping at your store. if you pay for it, you are required to maintain it, because a claim is the last thing you want.
